Still Beating

Terms

These terms cover purchases from Still Beating LLC, a Missouri company, on stillbeating.app and relivethis.com, and photos and videos uploaded there for an Etsy or partner order. By placing an order or uploading a file, you agree to them. Studios and other partners also have their own partner agreement.

Orders and payment

Prices are in US dollars. Missouri sales tax is added at checkout where it applies. Stripe processes all payments. An order is accepted once payment clears.

Your photos and videos

When you upload a photo or video, you confirm that you own it or have permission to use it for your print and video page. That includes permission from the photographer or videographer who made it, anyone whose performance or image it shows, and the owner of any music, artwork or logo in it.

You keep ownership of what you upload. You give us permission to print it, store it, and show it on your print's video page, for as long as we need to fill your order and host that page.

We may refuse or remove anything that is unlawful, that infringes someone's rights, or that we aren't willing to print or host. If we refuse an order before printing, we'll refund it.

You're responsible for what you upload. If someone makes a claim against us because of a file you sent, or because something you confirmed above wasn't true, you agree to defend us and cover our resulting losses, including reasonable legal fees. We don't review every file before printing, so don't rely on us to catch a problem.

We respond to copyright notices as described on our copyright page. We may refuse further orders from, and remove uploads by, anyone who repeatedly infringes someone's rights.

Video hosting

Your video page is hosted as described in our hosting policy.

Shipping and returns

Our shipping and returns policy is part of these terms. All sales are final, and we replace prints that arrive damaged, have a printing defect, or have a tag or QR code that doesn't play.

Limits

Colors can vary slightly between a screen and a print. NFC tags need a phone that supports NFC, and the printed QR code or the page address works as a backup where one is provided.

To the extent the law allows, our total responsibility for any order is limited to the amount you paid for it, and we aren't liable for indirect or consequential losses. Nothing here limits rights you have under the law that can't be waived. This limit doesn't apply to what you owe us under "Your photos and videos."

Governing law

Missouri law governs these terms.

Changes

We may update these terms. The version posted when you place an order applies to that order.
